Understanding Domestic Violence Injunctions

A domestic violence injunction, often referred to as a restraining order, is a legal tool that provides protection from abuse, harassment and threats within an intimate or familial relationship. Florida has four different types of domestic violence injunctions, specifically:

  • Domestic violence: A domestic violence injunction can be sought against anyone who the victim has lived with as family and who has committed an act of domestic violence against them. Oftentimes, this person is their spouse, but it could also be a parent, grandparent or adopted child, among other parties.
  • Sexual violence: A sexual violence injunction can be sought against anyone who is not family of the victim and who has committed an act of sexual violence against them. To obtain this injunction, the victim must have notified law enforcement of the act or the perpetrator must be imprisoned for the act and scheduled for release within the next 90 days.
  • Dating violence: A dating violence injunction can be sought against a current or past romantic partner of the victim who has committed an act of violence against them. To obtain this injunction, the victim must have dated the perpetrator within the past half year.
  • Repeat violence: A repeat violence injunction can be sought against individuals who do not fall under the purview of the previously listed injunctions, such as neighbors or colleagues, who have committed at least two acts of violence against the victim, at least one of which has happened within the past half year.
  • Stalking: A stalking injunction can be sought by any individual who is affected, the grounds for a Stalking Injunction being granted is the Court must find that the Respondent committed  harassing behavior which serves no legitimate purpose and that the harassing conduct caused the Petitioner emotional distress, this being a standard based on whether or not this behavior would have caused a reasonable person to suffer emotional distress.
